Professional Opinion & Expert Witness Service
1. Definitions
  1.1 "Consultant" shall mean a member of the panel of Chartered Surveyors, Structural Engineers.
  1.2 "The Guild" shall mean The Guild of Builders and Contractors.
  1.3 "The Member" shall mean the member of The Guild requesting the professional opinion and expert witness service.
  1.4 "The Professional Opinion and Expert Witness Service" shall mean the service provided by the Consultant to the Member and shall comprise:
  a. A review of correspondence, drawings, contracts and other relevant information provided by the Member.
  b. A consultation with the Member at the Consultant's office.
  c. Outline advice on possible future action.
  1.5 "The Fee" shall mean such fee as the Consultant and The Guild shall agree from time to time for the Professional Opinion and Expert Witness Service.
 
2. Consultant/Client relationship
  2.1 The Member shall be the Client of the Consultant
 
3. Member Responsibility
The Member:
  3.1 Shall properly and fully complete the Professional Opinion and Expert Witness Registration Form provided by The Guild.
  3.2 The Member shall forward to the Guild the said registration form and the fee.
 
4. The Consultant's Duty
The Consultant shall:
  4.1 Within seven days of receipt of the Member's registration form acknowledge receipt of the information provided by the Member.
  4.2 Within thirty days of receipt of the Member's registration form arrange a consultation with the Member and advise on future action.
 
5. The Guild's Responsibilities
  5.1 The Guild has arranged the Professional Opinion and Expert Witness Service as a service to Members but does not itself give advice nor shall it be responsible for any action, default or negligence of the Consultant or any dissatisfaction of the Member with the Consultant.
 
6. General
  6.1 The Member warrants that the information provided on the registration form is true, complete and accurate.
  6.2 Neither the Consultant nor the Guild accepts any responsibility for anything incomplete, false or inaccurate in the registration form.
  6.3 The Consultant may reject without comment or explanation any registration form which is not properly completed.
  6.4 These terms and conditions or part thereof may be varied at any time without notice.
