CONSTRUCTION (DESIGN & MANAGEMENT) REGULATIONS 2007

These Regulations came into force on 6th April 2007.

Introduction

The Construction (Design and Management) Regulations 2007 replace the Construction (Design and Management) Regulations 1994 and the Construction (Health, Safety and Welfare) Regulations 1996. The new Regulations are effective from 6th April 2007.

The new Regulations:

  • Alter the responsibilities of Clients
  • Alter the roles of Principal Contractors and Sub-Contractors.
  • Alter the roles of Designers
  • Replaces the Planning Supervisor with a new role of CDM Co-ordinator.

This document is intended to guide principal contractors through their responsibilities under the new Regulations. The Approved Code of Practice for the new regulations can be obtained from HSE Books (01787 811165).

 

The Principal Contractor

The Principal Contractor is responsible to ensure co-operation between all contractors working on the site to enable all contractors to comply with the requirements and prohibitions imposed under the relevant statutory provisions relating to construction work.  He has to ensure that every contractor and every employee at work in connection with the project complies with any rules contained in the Health and Safety Plan.  He must make sure that only authorised persons are allowed into any area where construction work is being carried out.

The principal contractor has particular duties and responsibilities in ensuring the safe management of a site.

There can only be one principal contractor for any site at any one time.
